1. Agreement to Terms

By accessing and using the Aura Intimates Global website (auraintimatesglobal.com), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use our website or services.

These Terms of Service govern your use of our website and our B2B services, including ODM (Original Design Manufacturing) and OEM (Original Equipment Manufacturing) services. They are website usage terms only. The commercial terms for any specific order — including pricing, payment, quantities, lead times, inspection, and shipping — are set out in the quotation, purchase contract, or order confirmation agreed for that order.

  • Based on pricing at the time of issue and subject to adjustment if material or market conditions change significantly

3.3 Minimum Order Quantities (MOQ)

Minimum order quantities depend on the service type, style, and production requirements of each project. The applicable MOQ is confirmed in your quotation or order confirmation, and may be adjusted for specific projects as agreed with our team.

4. Intellectual Property Rights

4.1 Our Designs (ODM)

For ODM services, the original designs, patterns, and technical specifications we develop remain our intellectual property. You receive a license to use these designs for the products you purchase from us. The specific scope of intellectual property ownership and the license granted — including any exclusivity for a given market — is set out in the applicable contract or order confirmation for your project.

4.2 Your Designs (OEM)

For OEM services, you retain all intellectual property rights to your designs. By providing us with your designs, you grant us a limited license to:

  • Manufacture products according to your specifications
  • Use your designs solely for the purpose of fulfilling your orders
  • Store your technical files for future orders

4.3 Confidentiality

We commit to maintaining the confidentiality of your designs, technical specifications, and business information. We will not disclose or use your proprietary information for any purpose other than fulfilling your orders.

8.3 Disclaimer and Remedy

We stand behind the limited warranty described in Section 8.1: products are warranted to conform to approved samples and agreed specifications, to be free from material defects in workmanship, and to meet the quality standards agreed for your order.

Where a product does not meet this limited warranty, your remedy is repair, replacement, or refund of the affected goods, as agreed with our team. Except for this limited warranty, and to the extent permitted by applicable law, we make no further warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.

9. Liability

Liability terms, including any limitations, are agreed in the quotation, sales contract, or order confirmation applicable to each order. Nothing in these website Terms of Service is intended to limit or exclude any liability that cannot be limited or excluded under applicable law.

10. Compliance and Regulations

10.1 Responsibilities and Compliance

Each party is responsible for the compliance obligations that apply to it under applicable law, the requirements of the relevant product, and the terms agreed for the order.

  • You are generally responsible for product compliance in your target markets, obtaining certifications and approvals for sale there, providing accurate labeling requirements, and handling your own import and export obligations
  • We are generally responsible for meeting agreed manufacturing and quality requirements, and for complying with Chinese export regulations applicable to our operations
  • Where a responsibility is not clearly allocated by law or contract, we will work with you to determine and confirm it before production
  • Each party is responsible for its own duties, taxes, and fees unless otherwise agreed in writing

10.2 Our Compliance

We work to keep our operations, and the partner factories we coordinate with, aligned to applicable requirements in the markets we serve, including recognized quality-management practices and Chinese export regulations.

Where specific certifications or test reports are required, we help coordinate the relevant documents with the appropriate factories or testing providers. The documents available for any given item depend on the product, the supplier or factory, and the requirements of your order, and they remain subject to the issuing body’s terms.

11. Termination

We may terminate or suspend your access to our services immediately, without prior notice, if you:

  • Breach these Terms of Service
  • Provide false or misleading information
  • Engage in fraudulent activities
  • Fail to make payments when due
  • Use our services for illegal purposes

Upon termination, all outstanding payments become immediately due, and we may cancel any pending orders.
